A New York Nursing Home Abuse Case Resolved

In the courtroom, Hon. Genine Edwards listened and took notes as the plaintiff’s attorney, John Dalli, of Dalli & Marino, referenced on-screen resident care progress notes. These progress notes are an important piece of evidence in the cross-examination in the trial of Vale Thomas, administrator of the estate of decedent Olive Roberts, v. Alliance Health Operations, LLC d/b/a Linden Center for Nursing and Rehabilitation. A witness was present to discuss the negligence and abuse that they saw as a wound care nurse from Linden Center. 

The plaintiff, Vale Thomas, maintained that her mother, Olive Roberts, was provided improper care and treatment by negligent staff during her time as a resident of the nursing home. It was alleged that Olive Roberts suffered from a stage four sacral pressure ulcer and pressure ulcers on both heels. It is alleged that these ulcers led to Roberts’ death in January of 2017 at 90 years old. The defendant’s attorney, Marci Mitkoff of the law offices of Marks, O’Neill, O’Brien, Doherty, and Kelly, disputed any claims of negligence or abuse in Robert’s care and treatment or violations of nursing home residents’ rights. 

Despite the defendant’s dispute of any claims of negligence or abuse, the jury returned a verdict awarding the plaintiff:

  • $375,000 for violations of the public health law
  • $375,000 for past pain & suffering
  • Total of $750,000 damages

This case was resolved in Kings County Civil Term.
