Cement Trucker Charged With School Bus Driver’s Death

This action arises out of a fatal motor vehicle collision that occurred on July 23, 2012.  On that day a cement truck operated by defendant Raymond Ragen struck a Long Island Railroad overpass on Oyster Bay Road in Locust Valley, New York. The cement truck was an oversized vehicle that could not clear the overpass and should not have attempted to do so.  After striking the overpass the cement truck then struck a mini school bus operated by decedent Jorge Guevara who was traveling in the opposite direction.  The force of the impact by the cement truck pinned the school bus to the sidewall of the overpass. Mr. Guevara sustained fatal injuries as a result of the collision. In addition to Mr. Guevara there were four other passengers on the bus including three children who sustained injuries.

Defendant Ragen was charged with charged with manslaughter, aggravated vehicular homicide, driving while impaired by drugs, and other charges. Mr. Ragen’s criminal trial is scheduled to begin in late 2013.

At the time of the incident Plaintiff’s decedent was employed by the Locust Valley School District as a bus driver.  He was the father of four minor children whom he supported.  The claims in this action sound in wrongful death as well as conscious pain and suffering and fear of impending death. Mr. Dalli represents the Estate of of JORGE GUEVARA, JORGE RENE GUEVARA, by his Guardian SALVATORE MARINO, GINISEE GISELLE GUEVARA, by her Guardian SALVATORE MARINO, JAYSON MISAEL GUEVARA, by his Guardian SALVATORE MARINO, and AMY DAYANARA GUEVARA SILVA.
