John Dalli, a partner in elder abuse law firm Dalli & Marino LLP, appeared on FOX NEWS’ “The Story with Martha MacCallum” on May 5 to discuss COVID-19’s devastating impact on nursing homes as well as Governor Cuomo’s recent “puzzling” directives for these facilities.
Dalli told MacCallum that New York State’s vulnerable nursing home residents were already at risk before Cuomo mandated all skilled nursing facilities in the state to admit or re-admit COVID-19 positive patients.
“Nursing homes prior to the COVID crisis were understaffed. When you add this pandemic on top of an already taxed system, and then you have an administration, a government, that requires COVID-19 patients to be admitted and readmitted into nursing homes, it was a ticking time bomb.”
What has made the situation even more critical, Dalli later noted, is how an executive directive in the recently passed New York State budget provides immunity to nursing homes for care that departs from standards that the law requires them to give to residents.
“With this sort of blanket of protection, it really disincentivized the nursing homes from providing the adequate care because they knew they were protected by this immunity.”
Dalli added, “So it’s troubling to me that at the same time the governor was providing immunity to these nursing homes, he was forcing them to take residents that they couldn’t take care of. So it’s very puzzling.”
