LORIEN QUESTELLES, as ADMINISTRATRIX OF THE ESTATE OF SARAH LESTER v. HIGHLAND CARE CENTER, INC. et al.

Sarah Lester, a mother and grandmother, was admitted to Highland Care Center for rehabilitation after a hospital stay. While a resident at the facility Ms. Lester developed painful bedsores as a result of the failure of Highland’s staff to turn and position her body while she was in bed. The failure to provide Ms. Lester proper care in accordance with New York State Nursing Home laws was proven by trial attorney John Dalli after a two and a half week trial in August of 2010. At trial, Mr. Dalli was able to show that the medical records certified as true by the facility contained false entries meant to show that care was given when in fact it was not. The jury’s verdict reflected their discontent with the nursing home for their attempt to mislead about the care Ms. Lester received. The award of punitive damages against the nursing home under the Public Health Law is one of the first in New York State.
