Kacsmaryk ruled to block a Biden administration rule that would have required nursing homes to meet higher staffing standards. The rule, which aimed to mandate 24/7 registered nurse coverage and a minimum of 3.5 hours of care per resident per day, was found to exceed the authority granted to the Centers for Medicare and Medicaid Services (CMS). The ruling came in response to a lawsuit filed by the American Health Care Association (AHCA) and other industry groups.
This decision represents a setback for those advocating for stronger protections for residents in nursing homes. The blocked rule was designed to address concerns about inadequate staffing, which can lead to neglect, injury, and other forms of harm. While the new standards may have been challenging for some facilities, they reflected a recognition that higher staffing levels often lead to better care outcomes.
