Founding partner at Dalli & Marino, John Dalli, recently shared his insights in a Newsday article examining the legal questions surrounding “granny cams” in Long Island nursing homes. The discussion comes amid growing concern over reports of abuse, neglect, and medical errors at Long Island nursing home facilities, which resulted in more than $511,000 in fines last year.
The article explores the rise of personal surveillance devices, often called granny cams, which families may install in residents’ rooms to monitor care. While 17 states have laws or guidelines permitting limited monitoring, New York remains in a legal gray area with no state laws explicitly allowing or prohibiting personal surveillance in nursing homes.
In the Newsday piece, Dalli emphasized the importance of transparency and respect for privacy when using these devices. He advised families to inform both the nursing home and any roommates before installing a camera. “Most residents in nursing homes are in double rooms,” Dalli explained. “A camera could pick up conversations about treatment or care, which could potentially violate somebody’s HIPAA rights.” His perspective highlights the delicate balance between protecting a loved one and respecting the privacy of others in the facility.
The article also notes ongoing legislative efforts in New York aimed at clarifying the rules for electronic monitoring, including proposals that would allow cameras in private spaces while restricting their use in shared areas and requiring consent from roommates.
