On June 28th, 2023, New York Attorney General Letitia James filed a new lawsuit accusing the executives behind nursing corporations in Queens, the Bronx, Westchester, and Buffalo of diverting Medicare and Medicaid funds away from nursing homes and into their own pockets. According to James, those in charge of the nursing homes in question misused over $83 million in taxpayer dollars, ABC7NY reports. Residents of the nursing homes owned by Centers Health Care suffered from many symptoms of abuse and neglect, including bedsores, malnutrition, and increased risk of death. This is the fourth largest action taken by the attorney general’s office in recent years to combat nursing home abuse and neglect exposed during the COVID-19 pandemic.

While nursing homes exist to protect and care for our most vulnerable populations, diversion of funds, understaffing, and other mismanagement can lead to abuse and neglect. If your loved one has suffered injuries due to a nursing home’s negligence, an experienced attorney can help you pursue the justice you deserve. At Dalli & Marino, LLP, our attorneys have been helping victims of nursing home abuse since 1995. We understand the challenges you face and will fight aggressively for your rights and interests while pursuing the maximum amount of compensation available for your losses.

Ways That Understaffing Can Lead to Nursing Home Abuse and Neglect

According to the lawsuit, many nursing home patients suffered harm due to understaffing. When nursing homes are not adequately staffed, patients may not receive the assistance and care they need, such as help going to the bathroom or answering their calls for help promptly. A few other ways understaffing can impact patients include the following:

Additionally, understaffing in nursing homes may result in patients being physically, emotionally, or sexually abused. Stress from understaffing and lack of time to properly care for patients can lead caregivers to take out their frustrations and use unnecessary force on their patients.
