Task Force of New York Lawyers Released a Report on the State’s Handlings of Nursing Homes During the Pandemic

The Covid-19 pandemic has been a devastating public health crisis. To date, 593,000 Americans have lost their lives from the virus, including over 50,000 New Yorkers. While the pandemic has been an unnerving experience for all New Yorkers, some have been disproportionately affected. Specifically, older people and individuals living with disabilities have been hit the hardest. As more information continues to come to light on the Cuomo administration’s handling of the pandemic—specifically, in regards to nursing home protocols—it’s no surprise a group of New York lawyers was assigned to a task force and asked to investigate what happened to individuals in long-term care facilities during the pandemic. 

John Dalli of Dali and Marino LLP Was Appointed to Nursing Home Task Force

Several members of the New York State Bar Association—including John Dalli, of Dalli and Marino LLP—were asked to serve on a task force committed to investigating how long-term care facilities handled the pandemic. John Dalli, like many of the other lawyers appointed to the task force, cares most about ensuring laws and policies take care of the vulnerable populations in nursing homes are protected post-pandemic. As part of their investigation, the task force examined whether the high death toll that occurred across New York’s nursing homes could have been avoided. 

Findings from the Task Force Report

The report recently published by the task force of New York lawyers suggests that pre-existing structures in the nursing home industry were partly to blame for the catastrophic Covid death toll experienced in their facilities. One of the biggest culprits suggested by the report is an understaffing crisis that has plagued the nursing home industry long before Covid created additional problems. Additionally, the report outlines issues related to structural, governmental, and provider-level systems that all contribute to protocols that can harm nursing home residents. In order to ensure the devastation caused by Covid never happens again in nursing homes, the task force suggests new policies and rules must be put in place.
