Recent Settlement for 300,000 Dollars

On March 13, 2014 attorneys John Dalli and Jeanne Ramasso of Dalli & Marino, LLP appeared before Justice Karen B. Rothenberg in Kings County to begin the trial of a nursing home negligence case involving a Queens County nursing home. Mr. Dalli and Ms. Ramasso  represented the Estate of a 73 year old woman who had been a resident of the nursing home for approximately four years.  The woman had been diagnosed with advanced dementia, diabetes mellitus, cardiovascular disease and peripheral vascular disease. During the last six months of her residency at the nursing home she was sent to the hospital for dehydration.  During her five day admission to the hospital she developed bedsores.  Upon her return to the nursing home the bedsores worsened and new bedsores developed. She remained at the nursing home for approximately five additional months before passing away.  Mr. Dalli and Ms. Ramasso brought claims against the nursing home for violations of the Public Health Law on behalf of the woman’s Estate for failing to properly monitor and treat her skin. After the selection of a jury and prior to opening statements the nursing home agreed to pay $300,000.00 to settle the claims.
