1.6 Million Dollar Settlement for Carpenter Injured in a Fall from Ladder

Gasparri v. Jones Apparel Group and Federated Department Stores:

Plaintiff Mario Gasparri recovered 1.6 Million Dollars for injuries sustained to his right arm as a result of a fall from an unsecured ladder while performing renovation work at a Macy’s Department Store. Mr. Gasparri was installing a drop ceiling in an area of the store being refurbished when the six foot ladder he was using to attach the ceiling suddenly shifted causing him to fall to the ground. The fall caused a fracture that required surgery and the worker missed several months of work as a result. Following surgery the worker required several weeks of physical therapy. Partner John Dalli brought suit alleging violations of the New York State Labor Law for failing to provide the worker with a properly placed and secured ladder. Prior to trial Mr. Dalli settled the case on behalf of the injured worker for 1.6 Million Dollars.
